Alabama Service Dog & Therapy Dog Guide

In Alabama, a service animal is a dog (or miniature horse) individually trained to perform tasks for a person with a disability, and it may go everywhere the public may go, including schools. Therapy dogs and emotional support animals are not service animals. This guide from Off Leash K9 Training Birmingham explains the rules and the steps to certify a therapy dog.

Alabama service dog law at a glance

  • Who qualifies: Alabama follows the federal definition. A service animal is a dog or miniature horse trained to do work or tasks directly related to the handler's disability. Emotional support, comfort or crime deterrence alone do not count (Ala. Code §21-7-1).
  • Where it can go: every area of a public place that the public may use, including public and private schools (§21-7-4(a)).
  • Control: the dog must be on a harness, leash or tether unless the disability or the dog's task prevents it; then the handler uses voice or signals (§21-7-4(b)).
  • No fees: a business may not charge a deposit or surcharge for a service animal, even if it charges for pets (§21-7-4(d)).
  • When a business can remove the dog: if it is out of control and the handler does not act, if it is not housebroken, or if it is a direct threat to safety. Allergies or fear of dogs are not valid reasons (§21-7-4(g)).

The only two questions a business may ask

When the dog's job is not obvious, staff may ask only: (1) Is the animal required because of a disability? (2) What work or tasks has it been trained to perform? They may not ask about the disability, ask for documents or an ID card, or ask the dog to demonstrate (§21-7-4(d); ADA.gov).

Service dogs in training have access rights in Alabama

The federal ADA does not cover dogs in training, but Alabama law does. A qualified trainer has the same access rights while training a service dog, as long as the dog wears a harness, collar, leash, cape or backpack saying in writing that it is a service animal in training, readable from at least 20 feet away (§21-7-4(c)).

No certificate or registry is required

The ADA does not require certification, vests or ID. Online "service dog registrations" give no legal rights and are not accepted as proof (ADA.gov FAQ). What makes a dog a service animal is its individual task training.

Misrepresenting a pet as a service animal is a crime in Alabama. Knowingly claiming to use a service animal, or to be a service animal trainer, is a Class C misdemeanor with 100 hours of community service; a second offense is a Class B misdemeanor with a $100 fine (§21-7-4(h)–(i)).

Housing and emotional support animals

Alabama law gives people with a disability full access to rental housing with a service animal, with no extra charge, though the owner is liable for damage and may be asked for proof of vaccination (§21-7-9). Emotional support animals are not service animals. Federal housing enforcement for untrained support animals changed in 2026, so check current HUD guidance or ask a lawyer before relying on an ESA letter.

How to certify a therapy dog in Alabama

Therapy dogs are registered by national organizations, not by the state. The usual path:

  1. Build solid manners. The AKC Canine Good Citizen (CGC) test, with 10 items such as walking through a crowd and reacting to another dog, is a prerequisite for many therapy dog certifications.
  2. Choose a registry and check its rules. Alliance of Therapy Dogs and Pet Partners both require the dog to be at least 1 year old; Pet Partners also requires 6 months in your home and no raw-meat diet.
  3. Get the health paperwork. A vet exam, current rabies vaccination and (for Alliance of Therapy Dogs) a negative fecal test within 12 months.
  4. Pass the evaluation and observed visits, plus a background check for adult handlers.
  5. Earn AKC therapy titles (optional): AKC does not certify therapy dogs but awards titles starting at 10 visits for dogs registered with a recognized organization.

In Birmingham: Hand in Paw (617 38th Street South) trains volunteer therapy teams for hospitals, schools and care communities in Jefferson, Shelby, St. Clair and Tuscaloosa counties. Its animals must be at least 18 months old, owned for 6 months, spayed or neutered, and dogs must complete a group obedience course.

Frequently asked questions

Does Alabama require service dog certification or registration?

No. Neither Alabama law nor the ADA requires certification, an ID card or a vest. Online registrations give no legal rights. A service dog is defined by its individual task training for a person with a disability.

Can a service dog in training go into stores in Alabama?

Yes, with a qualified trainer. Alabama Code §21-7-4(c) gives trainers the same access rights while training, as long as the dog wears gear stating in writing that it is a service animal in training, readable from 20 feet.

Is an emotional support animal a service animal in Alabama?

No. Alabama and the ADA both exclude animals whose only role is emotional support or comfort. Emotional support animals have no public access rights; housing rules are separate and changed at the federal level in 2026.

Is it illegal to fake a service dog in Alabama?

Yes. Knowingly misrepresenting a pet as a service animal is a Class C misdemeanor in Alabama with 100 hours of community service; a repeat offense is a Class B misdemeanor with a $100 fine (Ala. Code §21-7-4).

How old does a dog have to be to become a therapy dog?

Alliance of Therapy Dogs and Pet Partners require at least 1 year; Birmingham's Hand in Paw requires 18 months. Most teams start with the AKC Canine Good Citizen test, which has no minimum age.
